Supreme Court Orders Fresh Trial in 1996 Bus Blast Case Over Denial of Legal Representation

The Supreme Court on Tuesday ordered a fresh trial for a key accused in the 1996 Samleti bus blast case, ruling that the denial of legal representation to a person facing the death penalty fundamentally undermines the right to a fair trial. The court also acquitted another individual convicted in the case, finding that his confession was inadmissible as evidence.

The judgment, authored by Justice Sandeep Mehta on behalf of a bench that also included Justices Vikram Nath and Sanjay Karol, examines the constitutional right to legal counsel, the admissibility of confessions, and the standard of evidence required in terror-related prosecutions.

The case stems from an explosion on a Rajasthan Roadways bus traveling from Agra to Bikaner in May 1996 near Samleti in Dausa district, which killed 14 people and injured 37.

Lack of Legal Representation

Dr Abdul Hameed, who had been sentenced to death, will now face a trial for the third time. During his original trial, which led to his conviction in 2014, he was forced to cross-examine witnesses himself because he neither had a lawyer nor was provided one by the court. The Rajasthan High Court had recognized this flaw in April 2015 and remanded the case back to the trial court, which again sentenced him to death in December 2015.

The Supreme Court noted that the absence of legal representation affected the entire trial, not just the sentencing phase. It stated that the right to be defended by a lawyer "is not an empty ritual or a mere procedural embellishment; rather, it is a substantive safeguard that lies at the heart of a fair criminal justice system." Leaving an accused undefended in proceedings with serious penal consequences means "the fairness of the trial itself may stand seriously compromised," the court added.

Given the flawed trial, the court had to decide between acquitting Hameed or ordering a fresh trial. It chose the latter to balance the rights of the accused with "the nature and gravity of the offence, its impact on society and the larger interests of justice." Acquitting Hameed solely on the ground of denied legal representation, the court said, "would neither advance the cause of justice nor appropriately balance the competing interests involved." The court held that while a fresh trial is "an exceptional course," it becomes "indispensable where a constitutional infirmity is so fundamental that the conviction cannot be sustained" yet "the interests of justice require that the prosecution be carried to its logical conclusion."

The bench directed the establishment of a special court in Jaipur to conduct the trial expeditiously, preferably within a year.

Inadmissible Confession

While Hameed's case centered on procedural fairness, the case against another convict, Pappu alias Salim, was invalidated due to weak evidence. Salim had been sentenced to life imprisonment primarily based on his own confessional statements.

The bench found that Salim had been subjected to multiple recordings of confessions over a prolonged period. He gave his first confessional statement before a magistrate in September 1997 in connection with a separate blast case at Jaipur's Sawai Man Singh Stadium. Five years later, in October 2002, a second confession was recorded in the Samleti bus blast case. After the trial court raised concerns about procedural lapses, a third statement was recorded in January 2011. When produced before the trial court as an approver, the court noted that the multiple recordings and the circumstances surrounding them rendered the confession inadmissible. Consequently, the Supreme Court acquitted Salim, ruling that the evidence against him was insufficient to sustain a conviction.
