Three Men Sentenced for Abduction, Rape, and Harassment of Minor Girl in Kalaburagi
The Additional District and Sessions (Special POCSO) Fast Track Special Court-1 in Kalaburagi delivered three judgments on Friday, sentencing three individuals for separate incidents of sexual abuse against a 12-year-old girl.
Judge S.L. Chavan sentenced the primary accused, Nagesh alias Babu alias Babya, a 30-year-old mason from Mahadeva Nagar in Kalaburagi, to 25 years of rigorous imprisonment for abducting and repeatedly raping the minor. The court also imposed a fine of ₹45,000 on him.
In two other judgments, the court sentenced 20-year-old construction worker Shivaraj alias Surajya to three years of imprisonment for sexual harassment and blackmail, and 19-year-old auto-driver Mallikarjun Mallu to three years of imprisonment for abduction and wrongful confinement.
According to the prosecution, Nagesh stalked and abducted the victim in 2025, raping her on three occasions: March 22, April 1, and April 8. He also threatened the girl to keep silent about the incidents.
On April 6, Shivaraj began blackmailing the minor and sexually assaulted her at his residence, warning her of dire consequences if she spoke out.
On April 11, Mallikarjun forcibly took the minor to his house and confined her. The next day, he took her to a house in Dharmapur. On April 13, the victim's parents tracked them and brought her back, subsequently reporting the matter to the police.
Delivering the quantum of punishment for Nagesh, Justice Chavan sentenced him to 25 years of rigorous imprisonment and a fine of ₹25,000 under Section 6 of the Protection of Children from Sexual Offences (POCSO) Act. He also received two years of imprisonment and a fine of ₹10,000 under Section 12 of the POCSO Act, and additional sentences under the Bharatiya Nyaya Sanhita (BNS): six months for Section 127(2) and one year for Section 351(2), each with a fine of ₹5,000.
Shivaraj was sentenced to three years of imprisonment and a fine of ₹50,000 under Section 8 of the POCSO Act, along with six months and a ₹5,000 fine under BNS Section 127(2). Mallikarjun Mallu was sentenced to three years of imprisonment and a fine of ₹50,000 under BNS Section 137(2) (kidnapping), and six months and a ₹5,000 fine under BNS Section 127(2) (wrongful confinement).
The court directed the District Legal Services Authority to disburse compensation of ₹5,00,000 to the survivor in connection with Nagesh's case, and ₹50,000 each in the cases of Mallikarjun and Shivaraj, totalling ₹6,00,000. The judge ordered that the financial assistance must be handed over to the survivor within one month of the judgment.
