The Tamil Nadu Information Commission has expressed serious concern over the significant delay in providing replies to applications filed under the Right to Information (RTI) Act, 2005. In a recent letter to the state’s Chief Secretary, the former Chief Information Commissioner, Md. Shakeel Akhter, urged the government to implement online management of RTI applications and responses across all Secretariat departments, offices of Heads of Departments (HoDs), and district collectorates.

According to the Commission, while the process of filing RTI petitions online has started in some departments and collectorates, it remains ineffective and riddled with confusion. Public Information Officers (PIOs) have reported difficulties in handling online petitions, leading to substantial delays in providing replies to citizens. Akhter emphasised that this issue requires urgent attention to ensure compliance with the 30-day deadline prescribed under the RTI Act.

The Commission noted that many petitioners have complained about delays during inquiries, and that the full transition to online filing under Section 6(1) and first appeals under Section 19(1) of the RTI Act has not been achieved in key government offices. Akhter called for immediate steps to make online filing mandatory for all departments, HoDs, and collectorates.

Highlighting the constitutional importance of the RTI Act, Akhter stated that the law aims to promote transparency and accountability in public authorities. He stressed that a balance must be maintained between protecting sensitive information and upholding citizens' right to know about government functioning. He also suggested that the Commission’s website link be provided to all stakeholders to facilitate easier filing of petitions.

In an earlier communication, Akhter drew attention to Section 4(2) of the RTI Act, which mandates proactive disclosure of information by public authorities through various means, including the internet, to reduce the need for citizens to file formal applications. The Commission has urged the state government to prioritise this to improve transparency.
