Delhi Police Commissioner Gets NSA Preventive Detention Powers for Three Months

The Delhi government has authorised the Commissioner of Police to exercise preventive detention powers under the National Security Act (NSA) for a period of three months, effective from July 19 to October 18.

The order, which empowers Police Commissioner Anurag Kumar to detain individuals without immediate criminal prosecution, has been described by police officials as a routine administrative measure. They have clarified that the timing is unconnected to recent street protests by students and the activist platform Cockroach Janta Party (CJP).

The NSA, enacted in 1980, allows preventive detention in cases where a person is deemed to be acting in any manner prejudicial to the security of the state, maintenance of public order, or maintenance of essential supplies and services. The Act includes safeguards such as the requirement for a review within a specified period and the right to representation.

Preventive detention laws are intended as a preventive measure rather than punitive, allowing authorities to detain someone to prevent potential harm. However, such provisions have been subject to legal scrutiny and debate over civil liberties. The Delhi Police has emphasised that the authorisation is a standard procedure, often renewed periodically, and is not a response to any specific incident.

Section 3 of the NSA empowers the government to delegate detention powers to authorities such as the police commissioner. The current delegation was issued by the Delhi government under its administrative powers. The order does not name any individuals or groups.

Legal experts note that while the NSA provides broad powers, its application is subject to constitutional limits and judicial oversight. Detainees have the right to challenge their detention before a high court or the Supreme Court. The government is also required to review the detention within 12 weeks, with provisions for extension.

The timing of the order—coinciding with ongoing protests by students and activists over various issues—has drawn attention, but police have consistently stated the two are unrelated. The Delhi Police issued a statement saying the delegation is a periodic administrative step taken to maintain public order and security.
