Delhi consumer commission orders refund to Ghaziabad homebuyers after 15-year delay

In 2010, two families booked 3BHK apartments in Palm Wood Enclave, a housing project developed by Sanchar Nest Sahakari Awas Samiti Ltd in Wave City, Ghaziabad. The developer had promised possession by 2012. However, the project remained incomplete for 15 years.

The project was initially launched in Noida, but after alleged land disputes, it was shifted to Ghaziabad. Fresh agreements were signed in 2013. The project comprises 506 flats across three towers, but construction never reached completion.

According to the Uttar Pradesh Real Estate Regulatory Authority (UP RERA) portal, there are currently 23 complaints registered against this specific project.

This month, the Delhi State Consumer Disputes Redressal Commission ruled in favour of the two buyers. It ordered Sanchar Nest Sahakari Awas Samiti Ltd to refund Rs 79.43 lakh to the buyers, along with an additional Rs 5 lakh in compensation for mental agony and litigation costs.

The ruling provides some relief to the buyers after a prolonged legal battle. The commission directed the developer to pay the amount within a specified period, failing which interest would accrue.
