Chhattisgarh High Court grants jailed NEET aspirant exam privilege under police custody

The Chhattisgarh High Court has permitted a 21-year-old student in judicial custody to appear for the National Eligibility cum Entrance Test (NEET) re-examination while under police supervision. The court also directed jail authorities to provide study materials to help the student prepare for the test scheduled for June 21.

The student is currently in judicial custody in connection with a case involving alleged abetment of suicide of a 20-year-old woman in Raipur on April 20. An FIR was registered against the student on May 29, based on a seven-page note recovered from the woman's phone, which reportedly indicated that the student had been abusing her and forcing her to meet him.

Counsel for the petitioner, Ankul Biswas, requested an urgent hearing on June 15, emphasizing that the applicant had been diligently preparing for the NEET examination. The court considered the plea and allowed the student to take the exam under police custody, ensuring that his right to education is not compromised while he remains in legal custody.

The High Court's decision balances the student's constitutional right to education with the requirements of the legal process. The jail authorities have been instructed to facilitate the student's preparation by providing necessary study materials.
