Tamil Nadu Speaker Receives Explanations from Four Former AIADMK MLAs in Disqualification Case

Four former AIADMK MLAs facing disqualification proceedings under the Tenth Schedule of the Constitution appeared before Tamil Nadu Legislative Assembly Speaker J.C.D. Prabhakar in Chennai on Tuesday and submitted their explanations. The development marks the latest step in a case that stems from a rebellion within the party during a trust vote earlier this year.

Maragatham Kumaravel (Maduranthagam), P. Sathyabama (Dharapuram), S. Jeyakumar (Perundurai) and Esakki Subaya (Ambasamudram) met the Speaker at his chamber in the Secretariat and furnished their written replies. They were accompanied by AIADMK MLAs Agri S.S. Krishnamoorthy, N. Thalavai Sundaram and Thamarai S. Rajendran, who represented the party during the proceedings.

The disqualification petition was filed by AIADMK floor leader and general secretary Edappadi K. Palaniswami on May 13. It followed the voting on a motion of confidence in the Tamil Nadu Assembly, during which 25 rebel AIADMK MLAs supported the government led by Chief Minister C. Joseph Vijay's Tamilaga Vettri Kazhagam (TVK). The Speaker's decision on the petition is awaited.

Under the Tenth Schedule of the Constitution, commonly known as the anti-defection law, legislators may be disqualified if they defy a whip issued by their party. The law aims to preserve the stability of governments by preventing elected representatives from switching parties or voting against party directives without facing consequences. The Speaker is the authority empowered to adjudicate such petitions in the Assembly.

According to officials aware of the matter, Mr. Palaniswami later chose to condone the actions of 21 of the 25 MLAs who had voted against the party line. The remaining four members subsequently resigned from the Assembly and joined the TVK. These four former MLAs are now contesting the disqualification proceedings initiated against them, arguing their resignations and subsequent actions must be examined in light of the circumstances surrounding the trust vote.

Tuesday's appearance was not the first for the former legislators. They had earlier appeared before the Speaker on two separate occasions, submitting both oral and written explanations for their conduct during the vote. On each occasion, they maintained that their actions were consistent with their political convictions and that they were not subject to disqualification under the Tenth Schedule. The AIADMK, however, has insisted that the former MLAs violated the party whip and must face the consequences under the law.

The proceedings have drawn political attention because they test the boundaries of the anti-defection law in a scenario where MLAs resigned after voting against their party, and the party subsequently condoned the actions of some but not others. Legal experts note that the Speaker's ruling could set a precedent for how similar cases are handled in the future, especially in a multi-party system where coalition politics often creates complex whip situations.

The Speaker's office has not announced a timeline for a decision. The former MLAs have also indicated that they will challenge any adverse ruling in court, citing constitutional guarantees of freedom of conscience and the right to dissent. Meanwhile, the AIADMK has expressed confidence that the Speaker will uphold the party's position and enforce discipline.

Neither the Speaker nor the parties involved have issued detailed statements beyond confirming that the submissions were received. Observers say the case will be closely watched as it progresses, as it bears on the integrity of legislative processes and the balance between party discipline and individual representation in India's parliamentary democracy.
