Supreme Court Orders Audit of Lawyer Disciplinary Bodies, Proposes National Legal Academy

The Supreme Court on Tuesday directed the Bar Council of India (BCI) to conduct a comprehensive performance audit of the disciplinary mechanisms under the Advocates Act, 1961. The court emphasised that while self-regulation is central to the independence of the legal profession, maintaining public confidence in lawyers is equally important.

A bench comprising Justices P S Narasimha and Alok Aradhe observed that the International Bar Association's Caution List is meant only for serious misconduct, not for cases involving negligence or errors of professional judgement. The court's remarks came during the hearing of a case where a lawyer had been placed on the caution list without proper scrutiny.

In addition to the audit, the Supreme Court proposed the establishment of a National Legal Academy (NLA) to provide continuing legal education to lawyers. This academy would enable structured post-enrolment learning, enhance professional competence, and equip lawyers with necessary skills.

The court's directive aims to strengthen the disciplinary framework and ensure that lawyers uphold ethical standards. The BCI and state bar councils have been asked to submit the audit report within a specified timeframe.
