Supreme Court Mandates Clear Footpaths, Upholds Pedestrian Right to Walk

The Supreme Court of India has delivered a landmark judgement affirming the fundamental right of pedestrians to use footpaths without obstruction. The ruling directs all state governments and municipal bodies to ensure that footpaths are free from encroachments, including hawkers, parked vehicles, and other obstructions, within a stipulated timeframe.

In its judgement, the Court observed that the right to walk is an essential part of the right to life under Article 21 of the Constitution. It noted that footpaths are designed for pedestrians, and their encroachment violates the rights of citizens, particularly the elderly, children, and persons with disabilities. The Court emphasised that urban planning must prioritise pedestrian safety and accessibility.

The judgement came in response to a public interest litigation (PIL) highlighting the severe encroachment of footpaths in major cities, forcing pedestrians to walk on roads and exposing them to accidents. The Court directed authorities to conduct surveys, remove encroachments, and maintain footpaths regularly. It also instructed that hawkers be relocated to designated vending zones as per the Street Vendors Act, 2014.

The ruling has been welcomed by civil society groups and urban activists, who have long campaigned for pedestrian rights. However, implementation remains a challenge, as many cities have entrenched encroachments. The Court has set up monitoring committees to ensure compliance.

This judgement marks a significant step towards reclaiming public spaces for citizens and upholding constitutional values of equality and dignity for all.
