Madras High Court rules: Woman teacher cannot be denied posting to boys' school

The Madras High Court has held that a woman teacher cannot be denied a posting in a boys' school merely on the ground that the school lacks infrastructure for female staff. The court observed that neither the Tamil Nadu Private Schools Act nor the rules provide for such a prohibition in government-aided schools.

Justice B. Pugalendhi, hearing a petition from a high school teacher challenging the education department's decision to deny her posting, directed the authorities to reconsider her transfer order afresh. The court stated that the school's objection had no legal basis and that the authorities wrongly relied on the school's resistance instead of independently deciding the issue.

The petitioner, a qualified special teacher in drawing, was declared surplus at Sri Renuga Hindu High School during the academic year 2024-2025. On May 28, 2025, she was transferred to Gurugnana Sampandar Hindu Higher Secondary School, an aided non-minority private school. However, she was denied joining on the ground that it was a boys-only school, claiming lack of female staff and required facilities.

The teacher submitted an undertaking to the court that she would not seek any special treatment or additional facilities merely because she is a woman. Despite this, the authorities again sought the school's views and decided to deploy her elsewhere, leading to the present petition.

Justice Pugalendhi noted that public funds are spent not merely to pay salaries but to ensure students receive the benefit of adequate teaching staff. He pointed out that when a surplus teacher continues in one school, a sanctioned vacancy remains unfilled elsewhere, defeating the purpose of the deployment system.

The court also observed that there was an inordinate delay in issuing the transfer order, with no explanation provided. The government spends hundreds of crores of rupees every year towards teachers' salaries and has a corresponding obligation to ensure that teachers are effectively deployed.

The court directed the Virudhunagar district chief education officer, education officer, and the school to reconsider the transfer order strictly complying with the provisions of the law and rules.
