Judicial Officer Saurav Das Alleges Media Trespass at Home, Cites 'Grave Security Threat'

A judicial officer has approached the police with a complaint that media personnel attempted to break into his residence, describing the incident as a "grave security threat." The officer, Saurav Das, is reported to have said that the actions of the reporters endangered his family's safety and violated his right to privacy.

According to the complaint, a group of journalists gathered outside Das's home in connection with a matter he was handling and allegedly tried to enter the premises forcibly. The police have registered a case under relevant provisions of the Indian Penal Code, including those related to criminal trespass and intimidation. An investigation has been initiated, and authorities are examining CCTV footage from the area.

The incident has raised questions about the conduct of media personnel when covering judicial officers. While the press has a legitimate role in keeping the public informed, legal observers argue that this must not translate into harassment or intrusion into private spaces. Judicial officers, like all citizens, are entitled to security and privacy under the law.

Saurav Das, who serves in a district court, expressed concern that his primary duty of dispensing justice could be compromised by fear of such incidents. In his complaint, he reportedly sought enhanced police protection and requested that strict action be taken against those found responsible.

A senior police official said that the investigation is being conducted fairly. "We are recording statements from all parties involved. Any criminality will be dealt with according to law," the official said, adding that no arrests have been made so far.

The local Bar Association has condemned the alleged incident and extended its support to Das. In a statement, the association said that attacks on judicial officers, whether physical or verbal, undermine the independence of the judiciary. It also called on the media to adhere to ethical standards while covering court proceedings and judicial officers.

Legal experts point out that the right to freedom of speech and expression under Article 19(1)(a) of the Constitution is subject to reasonable restrictions, including those related to defamation and incitement to an offence. The right to privacy, recognised as a fundamental right, must also be respected. The balance between these rights is delicate, and incidents like the one reported by Das highlight the need for clear guidelines.

Various high courts and the Supreme Court have, in the past, issued directives to ensure that journalists do not interfere with the functioning of courts. For instance, the use of cameras inside court premises is regulated. However, the conduct of reporters outside courtrooms and at judges' residences has become a matter of concern.

In recent years, there have been multiple instances where judges have been followed by media crews, leading to demands for a code of conduct. While some media organisations argue that public figures should be accessible, others acknowledge the need to respect boundaries. The Press Council of India has often emphasised that the media should avoid sensationalism and respect the privacy of individuals.

Legal provisions such as Section 448 of the Indian Penal Code, which deals with house trespass, and Section 506 for criminal intimidation, may be invoked depending on the findings of the probe. The severity of punishment can range from imprisonment to fines, depending on the nature of the offence.

The police have sought time to complete the preliminary enquiry. It is expected that statements from the journalists involved will be recorded in the coming days. The judicial officer's family has also been provided security as a precautionary measure.

This case serves as a reminder that the freedom of the press comes with responsibilities. As the investigation unfolds, the hope is that it will lead to a constructive dialogue on the ethical limits of reportage, rather than further polarisation between the fourth estate and the judiciary.
