Delhi Court Cancels Arrest Warrants Against SFI Leader Aishe Ghosh in 2021 Case
A Delhi court on Thursday cancelled the non-bailable warrants (NBWs) issued against Aishe Ghosh, joint secretary of the Students' Federation of India (SFI), in a case dating back to 2021. Judicial Magistrate Vijayshree Rathore passed the order after Ms. Ghosh appeared before the court. A detailed order is awaited.
The case stems from an FIR registered at Barakhamba Road police station in 2021 under sections 188 (disobeying order issued by public servant), 447 (criminal trespass), and 34 (common intention) of the erstwhile Indian Penal Code (IPC). These sections pertain to disobedience of a public servant's order, criminal trespass, and common intention in committing an offence.
On Wednesday, the court had stayed the NBWs after Ms. Ghosh's counsel submitted that she could not appear on the previous hearing date due to unavoidable circumstances. The matter has now been listed for further proceedings on November 21.
Aishe Ghosh is a prominent student leader and has been involved in various student and political movements. The case is one of several legal proceedings involving student activists in recent years. The SFI, affiliated with the Communist Party of India (Marxist), has maintained that the charges are politically motivated.
The cancellation of the warrants allows Ms. Ghosh to be released from the immediate threat of arrest, pending the next hearing. Legal experts note that the court's decision to cancel the warrants following her appearance is a routine procedural step when a person complies with court orders.
