Belagavi IT firm serves notice to US Anthropic via Hague Convention in trademark row

A Belagavi-based software company, Anthropic Software Technology Company, has served a legal notice to its US counterpart, Anthropic PBC, through the Hague Convention mechanism in a trademark dispute.

The Indian company, founded by Mohammad Ayyaz Mulla, claims it holds prior usage rights as it was registered in India before the US firm was incorporated. According to Mr Mulla, the similarity in branding has caused marketplace confusion and reputational damage.

“We have submitted all relevant documents to the commercial court in Belagavi. Our firm was registered in the Indian registry office much before the US firm was registered in the USA or in India. The US firm has been using our trademark and passing it off as its own,” Mr Mulla said.

He added that the notice was successfully delivered to Anthropic PBC in San Francisco through the Hague Convention, a lengthy and procedurally demanding international legal process. The successful delivery is viewed as a significant procedural milestone.

As of now, the respondents have not accepted the allegations, and the issues remain subject to court determination. The next hearing is scheduled for July 23.

Mr Mulla expressed confidence in the judicial process, stating, “We remain determined to pursue our legal rights through due process. We have complete faith in the courts.”
