NIA Court Denies Interim Bail to Sunjwan Terror Accused Seeking Wedding Leave

A special National Investigation Agency (NIA) court in Jammu has denied interim bail to an accused in the 2018 Sunjwan terror attack case, who had sought temporary release to attend his sister's wedding. The court upheld the NIA's objection that attendance at a marriage ceremony does not create any legal entitlement to interim bail.

The accused had moved the court seeking permission to attend his sister's marriage, which was scheduled to take place shortly. In his plea, he argued that being present at a family occasion of such significance was a social obligation that warranted relaxation of custody rules. However, the NIA strongly opposed the request, submitting that in a case involving serious offences under the Unlawful Activities (Prevention) Act (UAPA), personal events like weddings cannot be grounds for temporary release.

The Sunjwan attack, which occurred on February 10, 2018, involved a group of heavily armed terrorists targeting the Sunjwan Army camp in Jammu. The assault resulted in the deaths of six soldiers and two women, while several others were injured. The NIA, which took over the investigation, filed a chargesheet against multiple individuals, including the current accused, who faces charges related to abetment of terrorism and conspiracy under various provisions of the Indian Penal Code and the UAPA.

During the hearing, the NIA argued that granting interim bail for wedding attendance would set a dangerous precedent in terror-related cases. The agency emphasised that the accused is a significant figure in the ongoing investigation and that his release could hamper the probe or lead to witness tampering. The court found these arguments persuasive, noting that the seriousness of the allegations and the nature of the case outweighed the personal inconvenience claimed by the accused.

Legal experts point out that interim bail is typically granted in extraordinary circumstances, such as medical emergencies or a death in the family. While courts do consider humanitarian grounds, they exercise caution in cases involving national security. In this instance, the court observed that the accused failed to demonstrate compelling reasons that would justify his temporary release.

This ruling reflects the judicial approach in terror-related matters, where the rights of the accused are balanced against the larger interests of society and ongoing investigations. The NIA's stance, that a wedding is a social event rather than a legal entitlement, was accepted by the court, which dismissed the bail plea.

The accused remains in judicial custody as the trial continues. The NIA court is expected to take up further matters in the case in the coming weeks.
