Manan Mishra Defiant: Won't Quit as BCI Chief Despite Supreme Court Plea

Bar Council of India (BCI) Chairman Manan Mishra has firmly refused to step down from his position, even as a plea seeking his removal is pending before the Supreme Court. Speaking to reporters, Mishra asserted that his tenure has been democratically elected and that he represents the interests of over 25 lakh lawyers across the country.

“I have served as the Chairman of the Bar Council of India for 12 to 14 years because I was elected. Manan Mishra represents 25 lakh lawyers; he will not step down simply,” he said, dismissing demands for his resignation.

The plea in the Supreme Court, filed by a group of lawyers, alleges that Mishra has continued in office beyond his valid term and seeks his removal. The petitioners have also raised concerns over the proposed increase in registration fees at State Bar Councils, arguing that it burdens young and aspiring lawyers. Additionally, they have renewed calls for the enactment of an Advocate Protection Act, which would provide legal safeguards for lawyers against violence and harassment while performing their duties.

Mishra’s defiant stance highlights a growing rift within the legal community. While his supporters point to his long tenure and electoral mandate, critics argue that the BCI has failed to address systemic issues, including the lack of transparency in its functioning and the delays in implementing welfare measures for advocates.

The Bar Council of India is a statutory body established under the Advocates Act, 1961. It regulates the legal profession in India, sets standards for legal education, and oversees the conduct of advocates. The chairman is elected by members of the council, and the position carries significant influence over the legal fraternity.

The Supreme Court is expected to hear the plea in the coming weeks. Legal experts say the outcome could have far-reaching implications for the governance of the legal profession in India. If the court rules against Mishra, it could set a precedent for fixed tenures and greater accountability for office-bearers in statutory bodies.

Meanwhile, the demand for an Advocate Protection Act has gained traction among lawyers, especially after recent incidents of violence against advocates in various states. The Act, if passed, would provide for stricter penalties for attacks on lawyers and ensure safety at workplaces, including court premises.

The proposed increase in registration fees has also sparked protests, with many young lawyers stating that they are already struggling financially. The BCI has defended the move, saying the additional revenue is needed to improve infrastructure and welfare schemes for advocates.

As the legal battle unfolds, Mishra remains resolute. “I have a mandate from the lawyers. I will not bow to pressure,” he reiterated. His future, and that of the BCI’s leadership, now rests with the Supreme Court’s decision.
