Madras HC seeks compliance report on transgender rehabilitation scheme at taluk level

The Madurai Bench of the Madras High Court has directed the Chief Secretary of Tamil Nadu to file a compliance report on the court's earlier directive to formulate a comprehensive rehabilitation scheme for transgender persons at the taluk level. The order was issued by Justice K.K. Ramakrishnan, who had initially set a deadline of July 26 for the report, later extended to August 21 after the status report filed by the Chief Secretary was found inadequate.

In its April 24, 2026 order, the court had instructed the State government to design a scheme that would open avenues of self-employment and sustainable livelihood for transgender persons, ensuring a life of dignity and meaningful inclusion in society. The directive also required the implementation of welfare measures tailored to their specific needs, including access to education, healthcare, and essential resources.

The court had further directed the Chief Secretary to coordinate with all relevant departments to ensure effective and time-bound implementation of these measures. A status report was subsequently submitted, but the court observed that it did not reflect compliance with the directions. As a result, the court directed the Chief Secretary to file a proper compliance report by August 21.

Expressing profound concern over the inadequate delivery of justice to transgender persons, the court took judicial notice of their prevailing socio-economic conditions. It noted that transgender individuals have historically faced systemic discrimination and exclusion, leading to what the judge described as 'cosmic sadness'. The court emphasised the need to undo, as far as possible, the historical wrongs inflicted upon them and to secure a life of dignity, equality, and meaningful participation in the social order.

The judge stated that effective social welfare measures should be framed and implemented to enable transgender persons to achieve self-sufficiency and full development. This includes creating meaningful economic opportunities, improving access to education and healthcare, and ensuring that they are brought into the mainstream of society.

The court's intervention comes amid growing recognition of the rights of transgender persons in India, following the Supreme Court's landmark 2014 judgment in National Legal Services Authority v. Union of India, which recognised a third gender and mandated affirmative action. The Madras High Court's directive seeks to translate these principles into concrete action at the grassroots level, where transgender persons often face the greatest challenges.

The next hearing is expected after the compliance report is submitted, with the court likely to review the progress made in implementing the rehabilitation scheme across all districts of Tamil Nadu.
