Karnataka Bill on public spaces sparks political row between BJP and government

The Karnataka Cabinet's approval of a Bill requiring private associations to obtain permission before using public premises has triggered a political confrontation between the ruling Congress and the opposition BJP. The Bill, formally named the Karnataka Regulation of Use of Government Premises and Public Property Bill, is expected to be tabled during the ongoing Monsoon Session of the state legislature.

The BJP has alleged that the legislation is an indirect attempt to target the Rashtriya Swayamsevak Sangh (RSS), while the government has dismissed the charge, saying the Bill applies to all associations equally.

Speaking to reporters, Karnataka BJP president B.Y. Vijayendra said that although the RSS is not named in the Bill, the intent is clear. He challenged the government to directly ban the RSS if it had the courage. “The government should try to ban the RSS if it has the courage,” he said, adding that the BJP would not tolerate any attempt to target the organisation. He also noted that the RSS had previously been banned but had continued to grow, and advised the Congress government to learn from history.

Leader of the Opposition in the Assembly, R. Ashok, echoed a similar sentiment, warning that targeting the RSS could have political consequences for the ruling party when the Assembly term ends in about 18 months.

Home Minister Priyank Kharge responded sharply to Mr. Ashok's remarks. He said the statement implied that one could not step out of one's house after criticising the RSS. “Is he implying that the RSS is a terrorist organisation or an underworld mafia that finishes off those who question it?” Mr. Kharge asked. He asserted that he draws protection from the Constitution and moral courage from Babasaheb Ambedkar to speak freely.

Mr. Kharge also questioned why the BJP felt the Bill was aimed specifically at the RSS. “Such anxiety will haunt only those who are guilty,” he said, suggesting that the organisation's concerns were unfounded.

The Bill, if enacted, would require private associations and organisations to seek prior permission from the government to use public spaces such as grounds, auditoriums, and other government-owned premises. This provision has been read by the BJP as an attempt to restrict RSS activities, which often involve large public gatherings.

The Congress government, however, has maintained that the legislation is intended to bring transparency and order to the use of public property, and that no specific organisation is being targeted.

The exchange marks yet another flashpoint between the two parties, which have frequently clashed over issues related to the RSS and its affiliated organisations. Previous Congress governments in Karnataka have also faced similar criticism for decisions perceived as targeting the Sangh.

The Bill's fate in the legislature remains to be seen, with the BJP expected to oppose it strongly. The government has not yet indicated whether it will consider any amendments in response to the opposition's concerns.
