J&K Minister Satish Sharma seeks CM's intervention against Transport Commissioner's 'defiance'

Jammu and Kashmir Minister Satish Sharma has formally asked Chief Minister Omar Abdullah to intervene in a row with a senior bureaucrat, alleging "defiance and disrespect" towards the authority of his ministry. Mr. Sharma, who holds the Transport portfolio among other responsibilities, has sought the immediate transfer of Transport Commissioner Vishesh Paul Mahajan.

In a letter to the Chief Minister, Mr. Sharma said Mr. Mahajan's conduct had "given rise to open defiance to written or verbal directives, bypassing, discourteous conduct and communication towards the Minister." He said the officer's continued defiance had reached a point where the orderly administration of the Transport Department was being "seriously compromised."

Mr. Mahajan was appointed to the post by the Lieutenant-Governor in December 2024. The Minister said he was compelled to raise the matter formally after exhausting other means of resolving it. He emphasised that the Transport Commissioner functions as the principal executive officer of the department under the policy direction and overall supervision of the Minister-in-charge, who remains answerable to the House and to the public.

"Persistent insubordination by a senior officer not only undermines the authority and dignity of the elected office but also disrupts the chain of administrative accountability, adversely affects the morale of the Department, and ultimately impedes the delivery of public services to the citizens," the letter states.

Mr. Sharma has requested that Mr. Mahajan be "immediately moved out" of the post of Transport Commissioner and a suitable officer of appropriate seniority be posted in his place. The Chief Minister's office has not issued a response so far.

The confrontation between the elected government and the L-G administration over transfers and postings has been ongoing since the government took office in October 2024. The two sides have yet to finalise the Transaction of Business Rules, a key document that defines the domain of the Chief Minister, the Council of Ministers and the Lieutenant-Governor in the Union Territory. Until these rules are settled, the L-G has continued to exercise authority over appointments, often leading to friction with the elected Council of Ministers.

This is not the first time Mr. Mahajan's posting has caused disagreement. Earlier, the Omar Abdullah government had objected to his transfer from Deputy Commissioner, Reasi, to Director, Tourism, Jammu, a move made by the L-G. The present case is another instance of the ongoing tussle over the control of bureaucracy.

The Transport Department is a key public-facing department, handling vehicle registration, licences, and enforcement of motor vehicle rules across J&K. Administrative instability in the department can potentially affect millions of residents who rely on these services. However, the specific impact of the current dispute on the department's functioning is not yet documented.
