FSSAI Flags 6 Food Firms Over Misleading '100% Pure', 'Energy', Immunity Claims

The Food Safety and Standards Authority of India (FSSAI) has flagged six food companies for making misleading claims on their product labels and advertisements, covering items such as coconut oil, energy drinks, and baby food. The regulator's action highlights growing concerns about unsubstantiated marketing practices in the food industry.

According to FSSAI, the flagged claims include assertions of "100%" purity, the use of the term "energy drink" to imply enhanced performance, and immunity-boosting benefits that lack adequate scientific evidence. These claims, the regulator said, could mislead consumers into purchasing products based on false or exaggerated promises.

FSSAI, which operates under the Ministry of Health and Family Welfare, is responsible for regulating food safety and standards across India. Under the Food Safety and Standards Act, 2006, the authority has the power to prohibit misleading advertisements and enforce accurate labelling. Companies found violating these norms can face penalties, product recalls, or cancellation of licences.

The action against the six firms is part of the regulator's ongoing surveillance of the market. FSSAI has repeatedly cautioned food businesses against making claims that are not backed by credible scientific evidence. In recent years, it has formally banned the use of terms such as "health drink" for products that do not meet defined nutritional criteria, and has tightened rules on front-of-pack labelling.

Consumer rights advocates have welcomed the move, noting that misleading food claims are a serious public health concern. For instance, "100%" claims on coconut oil or other edible oils often fail to clarify whether the product is unadulterated or simply free from certain additives. Similarly, "energy drinks" are frequently marketed to young people with suggestions of improved physical or mental performance, even when they are high in sugar and caffeine and offer no measurable benefit beyond the natural effects of these stimulants.

Immunity claims became particularly widespread during the COVID-19 pandemic, when many food and beverage brands marketed products as boosting immunity without robust clinical evidence. FSSAI has since issued guidance that any such claim must be supported by scientific proof and cannot be made unless the product meets specific nutritional requirements.

The latest flagging, though not naming the companies, serves as a warning to the broader industry. FSSAI is expected to issue detailed notices and may conduct further investigations. If the companies fail to comply with corrective instructions, they could face legal consequences under the Act.

For consumers, this action underscores the need to read product labels carefully and be sceptical of marketing language. While regulators and courts play a role in curbing unfair trade practices, informed choices remain the first line of defence against misleading claims. Consumers are advised to check ingredient lists, nutritional information, and certification marks before making a purchase.

FSSAI's crackdown is part of a larger effort to align Indian food standards with international best practices. The regulator has also been working on a unified system for approving health claims and has urged companies to adopt transparent labelling. As the food market grows, so does the responsibility of all stakeholders to ensure that what is printed on a packet is honest and accurate.
