Delhi High Court Cancels Bail of Teacher in Rape Case of 3-Year-Old
The Delhi High Court on Wednesday cancelled the bail granted to a female teacher accused in the alleged rape of a three-year-old girl inside a private school in West Delhi. The court directed the teacher to surrender within three days.
Justice Saurabh Banerjee found that the trial court had erred by ignoring crucial facts when granting bail. The lower court had primarily based its decision on the child's failure to name the teacher in the initial complaint. However, the child later identified the teacher in a statement recorded before a magistrate.
The High Court observed that there "may be some likelihood" of the teacher tampering with evidence or influencing witnesses, given her 13-year tenure at the school and her position of authority. The case is registered under the Protection of Children from Sexual Offences (POCSO) Act.
Earlier, on June 29, the High Court had set aside the bail granted to the main accused, the school's caretaker, and ordered him to surrender on July 1. The case continues to be under investigation.
