CPI urges CBI to challenge HC order acquitting former Puducherry MLA in disproportionate assets case

The Communist Party of India (CPI) has formally called upon the Central Bureau of Investigation (CBI) to file an appeal in the Supreme Court against a recent Madras High Court order that set aside the conviction of former Puducherry legislator Ashok Anand in a disproportionate assets case.

In a statement issued on Thursday, CPI state secretary A. M. Saleem said a Special Court in Puducherry had convicted Anand and his father, C. Anandan, a retired Public Works Department officer, in a corruption case registered by the CBI. The two were found guilty of possessing assets disproportionate to their known sources of income.

Anand, who had served as a legislator from the Karaikal region, subsequently challenged the Special Court's verdict before the Madras High Court. The High Court, in its recent judgement, set aside the conviction. The CPI has now urged the CBI to approach the Supreme Court to contest this ruling.

“The CBI should file an appeal against the High Court order in the Supreme Court,” Saleem said, adding that the conviction by the Special Court was based on substantial evidence. The party's appeal comes amid growing concern over the legal process in corruption cases involving public representatives.

The case dates back to a CBI investigation into allegations that Anand and his father had accumulated assets far exceeding their legal income. After a long investigation, the Special Court had found them guilty, but the High Court's intervention has altered the legal landscape. The full text of the High Court judgement has not yet been made public, and the CBI has not announced its next course of action.

Legal experts note that the Supreme Court is the final appellate forum in such matters, and only a court of that stature can overturn or uphold the High Court's decision. The CBI, as the prosecuting agency, has the discretion to file a special leave petition in the Supreme Court. However, such a petition requires the court's permission to be heard, as it is not an appeal as a matter of right in all criminal cases.

The CPI's demand is significant because it reflects a political party's direct interest in ensuring that corruption cases are pursued to their logical conclusion. The party has maintained that the judiciary must deal strictly with cases of corruption, particularly involving elected representatives, to preserve public trust in democratic institutions.

The case has drawn attention because it involves a former lawmaker, raising questions about accountability and the effectiveness of anti-corruption measures in the union territory of Puducherry. Ashok Anand was a prominent CPI leader during his tenure, and his conviction and subsequent acquittal have been closely followed in political circles.

The response of the CBI to the CPI's appeal remains awaited. The agency is expected to review the High Court judgement and take a decision based on legal merit. If the CBI decides to approach the Supreme Court, the top court will then examine whether the High Court's decision warrants any interference.

This development also comes at a time when the country is witnessing intense debate on judicial transparency and the pace of corruption trials. The outcome of this case, whichever way it goes, is likely to have implications for how similar cases are handled in the future.

As of now, the legal status of Anand and his father remains that of acquitted individuals, subject to any further legal action. The CPI's call for an appeal is part of a broader demand for strict action against those found guilty by trial courts, even if higher courts take a different view. The matter now rests with the CBI and, eventually, the Supreme Court.
