Calcutta High Court Questions TMC MLA's Challenge to LoP Recognition
The Calcutta High Court on Tuesday raised questions about the practical implications of a dispute over the recognition of the Leader of the Opposition (LoP) in the West Bengal Assembly. The court was hearing a petition filed by Trinamool Congress (TMC) MLA Sovandeb Chattopadhyay challenging the Assembly Speaker's decision to recognise Ritobrata Banerjee as the LoP.
A division bench comprising Justice Shampa Sarkar and Justice Ajoy Kumar Gupta asked, “What is the problem if someone else is made the LoP?”
Senior Advocate Kalyan Banerjee, appearing for Sovandeb Chattopadhyay, argued that the 80 MLAs of the TMC legislative party had won on the party symbol and under its leadership. He contended that the Speaker's decision violated the party's internal democratic processes.
The bench then sought to know whether any TMC MLA had protested against the selection of the LoP between May 9 and May 20. Banerjee responded that no protest was registered until May 27.
The court's query highlights the legal and political nuances in the recognition of the LoP, a position that carries statutory importance in state legislatures. The matter is scheduled for further hearing.
