Brazil Challenges Trump Tariffs at WTO, Calls Them 'Unjustified'
Brazil has formally requested consultations with the United States under the World Trade Organization's dispute settlement system, escalating a trade conflict triggered by tariffs imposed by the Trump administration earlier this month. The Brazilian Foreign Relations Ministry announced the move on Monday, stating that the tariffs violate global trade rules.
The dispute centres on two sets of US tariffs: a 25% levy on select Brazilian goods, justified by Washington on grounds of alleged unfair trade practices, and additional tariffs of up to 12.5% on products from dozens of nations, including Brazil, linked to accusations of inadequate enforcement of forced labour bans. Brazil contends that both measures are “unjustified and inconsistent” with the United States' obligations under the WTO's General Agreement on Tariffs and Trade 1994 and the Understanding on Rules and Procedures Governing the Settlement of Disputes.
This is not the first time Brasília has turned to the WTO in response to US tariffs. Last year, Brazil challenged a previous round of Trump-era tariffs, which were later struck down by the US Supreme Court. The current request marks a continuation of Brazil's strategy to defend its export interests through multilateral mechanisms.
The WTO consultations are the first step in the organisation's dispute resolution process. If the two sides fail to reach a settlement within 60 days, Brazil may request the establishment of a dispute settlement panel to adjudicate the matter. The outcome could take months or years, but the move signals Brazil's determination to push back against what it sees as protectionist measures by the United States.
President Luiz Inácio Lula da Silva's government had previously indicated it would take the matter to the WTO, fulfilling a campaign promise to assertively defend Brazilian trade interests. The tariffs affect a range of Brazilian exports, including steel, aluminium, and agricultural products, potentially impacting thousands of jobs and billions of dollars in trade.
The United States has defended its tariffs as necessary to combat unfair trade practices and ensure compliance with labour standards. However, critics argue that the measures are a form of economic coercion that undermines the rules-based trading system. The WTO has previously ruled against US tariffs in similar cases, but enforcement remains a challenge.
Analysts say the case could set an important precedent for how the WTO handles disputes involving trade and labour issues. Brazil's decision to pursue consultations underscores the growing tensions between major economies over trade policy and the role of international institutions in resolving such conflicts.
