Army Havildar Dismissed, Sentenced to One Year for Assault on Major General's Wife

An Army Havildar has been dismissed from service and sentenced to one year of rigorous imprisonment by a Summary Court Martial (SCM) for assaulting the wife of a Major General. The court found the soldier guilty of using criminal force with the intent to outrage a woman's modesty, an offence under the Army Act and the Bharatiya Nyaya Sanhita, 2023.

The incident occurred on May 19, 2026, at a temple located within the Major General's official residence at a military station. The Havildar, who worked as a washerman and was responsible for maintaining the temple, was on duty that morning when the complainant entered to offer prayers. According to the charge, he grabbed the woman from behind, attempted to grope her, and tried to cover her mouth when she tried to scream. She managed to escape and ran towards the house, with the Havildar chasing her, before he was apprehended by guards.

During the court martial proceedings, the Havildar made a voluntary confession, admitting to the act on three separate occasions—before his Commanding Officer, an independent board of officers, and during the summary of evidence. The Commanding Officer noted that the evidence against him was largely uncontested, and the Havildar did not cross-examine any prosecution witnesses.

In his confession, the soldier expressed deep shame and remorse, apologised unconditionally, and sought forgiveness. He also stated that he was beaten by guards after the incident, sustaining head injuries that required hospitalisation. The court considered his 24 years of unblemished service but proceeded with the conviction and sentence, which includes dismissal from service and one year of rigorous imprisonment.

The case highlights the military's disciplinary process for handling offences committed by service personnel, with the Summary Court Martial providing a swift resolution to the matter.
