US Justice Department subpoenas NYT journalist's records in North Korea leak probe

The United States Justice Department has issued a subpoena for records belonging to Matthew Cole, a freelance journalist who co-wrote a New York Times story about a US military operation in North Korea. The newspaper disclosed the matter on Saturday, stating that Virginia prosecutors sought more than two years of Cole's notes and his testimony.

The subpoena, issued in February, is part of an investigation into the sourcing of a 2025 article that detailed an alleged incident involving US Navy SEALs. According to the Times report, the SEALs killed several unarmed North Koreans in early 2019 while attempting to plant a listening device near the country's coast. The article attributed its information to two dozen unnamed sources.

The New York Times quoted its spokesperson, Charlie Stadtlander, as saying, “We support Matthew Cole’s decision to make public a subpoena that the government has attempted to keep secret.” Stadtlander described the move as “another brazen and illegal attack from the administration designed to deny the public information of vital importance.”

The Justice Department did not address Cole's specific case. A spokesperson said, however, that the department “will use all available legal tools to uncover those who unlawfully disclose national defence information.” Cole's attorney, David A. O'Neil, said his client's reporting “helps the public understand what the government is doing in its name” and asserted that Cole “will not be intimidated by efforts to suppress information that the administration considers unflattering.”

The Times has confirmed that it is covering Cole's legal expenses. The case underscores an ongoing tension between government efforts to prevent leaks of sensitive information and press freedoms protected under the First Amendment. Journalists and media advocates argue that such subpoenas create a chilling effect on reporting, while government officials contend that identifying leakers is essential for national security.
