Transgender ID Cards to Stay Valid Until SC Rules on New Law, Centre Assures

The Union government has assured the Supreme Court that identity cards issued to transgender persons under the earlier legal framework will remain valid until the court disposes of a batch of petitions challenging the Transgender Persons (Protection of Rights) Act, 2019. The submission was made on behalf of the Centre during a hearing on Tuesday, offering interim relief to thousands of transgender individuals who feared disruption of their existing documentation.

The assurance means that no transgender person will be required to immediately surrender or replace their current ID cards, even as the central law mandates the issuance of new certificates by district magistrates under its provisions. The government's statement was recorded by the Bench, which is examining constitutional challenges to the law and its rules.

The Act, enacted in 2019, was designed to provide legal recognition and welfare measures for transgender persons. However, petitioners have argued that certain provisions, particularly those requiring mandatory certification by district-level screening committees, violate the right to self-identify gender as recognised by the Supreme Court in earlier judgments. The challenges also question specific rules notified in 2020 that impose additional procedural hurdles.

During the hearing, the Centre's counsel submitted that the existing ID cards would remain effective for all official purposes until the court renders its verdict. This was done to ensure that no transgender person is denied access to education, employment, healthcare, or other public services due to a pending legal dispute. The Bench appreciated the submission and directed that the interim arrangement be formally recorded.

The Supreme Court has scheduled the next hearing for April, allowing both the petitioners and the government to complete their written submissions. Legal experts note that the Centre's stance is significant as it demonstrates a willingness to balance legal scrutiny with humanitarian considerations. Transgender rights activists have welcomed the move, though they continue to press for amendments to the law that align with the principle of self-identification.

This development comes amid broader judicial review of legislation affecting marginalised communities. The outcome of these petitions is expected to shape the future of transgender rights in India, particularly in matters of legal recognition, affirmative action, and anti-discrimination protections.

Supreme Court Upholds Madras HC Order Striking Down Tamil Nadu Reservation Notification for Converts

The Supreme Court has dismissed the Tamil Nadu government's appeal and upheld a Madras High Court order quashing a State notification that extended reservation benefits to converts to Islam from communities already listed as backward. A Bench headed by Justice Prashant Kumar Mishra held that conversion alone does not make a person a member of a notified backward Muslim community, and that the notification created an 'artificial group' without the statutory social checks the law requires.
