Tarun Tejpal appeals to Supreme Court against 10-year jail term in 2013 sexual assault case

Former Tehelka editor Tarun Tejpal has filed an appeal in the Supreme Court challenging the Bombay High Court's conviction and 10-year rigorous imprisonment sentence in a 2013 sexual assault case. The appeal was submitted on Thursday, August 20, 2026.

The appeal is directed at the August 6, 2026 judgment of a Division Bench of the Bombay High Court, consisting of Justice Neela Gokhale and Justice Amit Jamsandekar. The Bench set aside the trial court's 2021 acquittal and held Tejpal guilty. It described the trial court's ruling as "perverse" and said the judge had wrongly assumed that a complainant in a sexual assault case must conduct herself in a particular way to be deemed credible.

In a separate plea, the State of Goa moved the Supreme Court on Tuesday, August 18, seeking enhancement of the sentence. The state said the 10-year term was manifestly inadequate, but it did not ask the court to revisit the High Court's findings on the merits of the case.

During the High Court proceedings, Tejpal had pleaded for leniency, calling himself a "political victim" and a father of two daughters. Solicitor General Tushar Mehta, who represented the Goa government, argued for the maximum punishment, saying it was necessary to send a strong message to society about the consequences of sexual assault.

The case stems from a complaint of sexual assault made against Tejpal in 2013. He was arrested that year and later granted bail by the Supreme Court. In 2021, the trial court in Goa acquitted him, a decision that was overturned by the High Court this month.

The High Court's observations on the "perfect victim" stereotype are notable. The Bench stated that the trial court's expectation that the complainant should behave in a particular manner was flawed. According to the High Court, such reasoning had led to a perverse judgment.

Now, the Supreme Court will examine both the appeal against conviction and the state's plea for a harsher sentence. The court will first consider whether to admit the appeal and whether any interim relief, such as a stay on the sentence, is warranted.

Tejpal has consistently denied the allegations. His legal team has maintained that the High Court's verdict is based on a misreading of the evidence. The complainant's side has, however, expressed confidence in the High Court's decision.

The case has drawn considerable attention because of Tejpal's standing as a journalist and the nature of the allegations. The outcome of the Supreme Court proceedings will be significant for the legal framework surrounding sexual assault cases in India.

Supreme Court Upholds Madras HC Order Striking Down Tamil Nadu Reservation Notification for Converts

The Supreme Court has dismissed the Tamil Nadu government's appeal and upheld a Madras High Court order quashing a State notification that extended reservation benefits to converts to Islam from communities already listed as backward. A Bench headed by Justice Prashant Kumar Mishra held that conversion alone does not make a person a member of a notified backward Muslim community, and that the notification created an 'artificial group' without the statutory social checks the law requires.
