Supreme Court Questions Need for Independent Probe into Police Action at CJP Protests
The Supreme Court of India on Tuesday raised questions about the absence of an independent investigation into the police action during the protests organised by the Civil Justice Party (CJP). Hearing a petition, the bench observed that a fair and transparent probe is essential to maintain public trust in the law enforcement agencies.
The court noted that while the state has the right to maintain law and order, any excessive use of force must be examined without bias. The bench asked why the government had not considered an independent inquiry, especially given the serious allegations of misconduct made by the protesters.
The petition, filed by the CJP, alleges that police used disproportionate force, including lathi-charge and arbitrary arrests, during a peaceful demonstration in the capital last month. The state government, in its response, defended the police action, stating it was necessary to prevent violence and damage to public property.
However, the court expressed dissatisfaction with the internal departmental inquiry initiated by the police, stating that it lacks the perception of independence. 'Why not an independent probe?' the bench asked, adding that such an investigation would be in the interest of justice and would also protect the reputation of the police force.
The matter has been adjourned for further hearing, with the court directing the state to file a detailed response on the feasibility of an independent probe. The CJP has also been asked to provide specific instances of alleged excesses.
