Supreme Court Questions Need for 'Digital Arrest' as Standalone Offence Amid Rising Scams

The Supreme Court on Tuesday raised the question of whether 'digital arrest' and related cybercrimes should be formally defined as a standalone offence under Indian penal law. A three-judge bench headed by Chief Justice Surya Kant asked the government to consider if the current legal framework adequately addresses the growing menace of digital arrest scams, which have caused widespread financial and psychological harm.

During the hearing, Chief Justice Kant observed that existing penal provisions — including those covering robbery, extortion, and dacoity — already contain elements that could apply to such scams. However, he questioned whether a separate, clearly defined offence would help law enforcement and deter criminals more effectively. “Do we need to formally define digital arrest or related cyber crimes in the penal law? There are ingredients of robbery, extortion, dacoity… everything is there. Do you need it to define it as a standalone offence?” he asked Attorney-General R. Venkataramani, who represented the Union government.

Mr. Venkataramani responded that the offences are already covered under existing laws, suggesting that no new standalone provision may be necessary. The court further explored whether assets of individuals under investigation should be seized if a prima facie case is made out against them, indicating a push for stronger enforcement measures.

The Chief Justice had previously described digital arrest scams as the “most disturbing” form of cybercrime, noting that they cause not only financial loss but also a “blistering sense of violation” among victims. He emphasised that such crimes must be treated as offences against human dignity, not merely economic offences.

According to records submitted by the Ministry of Home Affairs in April, over 2.41 lakh complaints related to digital arrest scams have been registered. The court had taken suo motu cognisance of the issue in January this year, highlighting that fraudsters often pose as police or judicial officers, psychologically coercing victims into handing over their savings to avoid fictitious arrests or legal action.

The Supreme Court's observations come amid a surge in cyber fraud cases across the country, where victims are manipulated through video calls and fake legal documents. The court is expected to continue hearing the matter and may issue guidelines or directions to strengthen the legal framework and enforcement mechanisms.
