Supreme Court makes interim bail absolute for ex-UP MLA Abbas Ansari in Gangsters Act case

The Supreme Court of India on Tuesday made the interim bail granted to former Uttar Pradesh MLA Abbas Ansari absolute in a case registered against him under the Gangsters Act. A Bench headed by Chief Justice of India Surya Kant passed the order, with a condition that Ansari inform the police before leaving the State.

The order effectively converts his temporary relief into a regular bail, subject to the travel condition. This means Ansari will no longer need to approach the court for extension of the interim arrangement. The decision brings a degree of finality to the proceedings in this particular case.

Abbas Ansari is a former legislator from the Suar assembly constituency in Rampur district. He is the son of the late Mukhtar Ansari, a gangster-turned-politician who was also a sitting MLA when he died. Abbas Ansari has been involved in multiple criminal cases, and the current matter pertains to charges under the Uttar Pradesh Gangsters and Anti-Social Activities (Prevention) Act, 1986. This law is designed to curb organised crime by enabling attachment of property and imposing stringent conditions for bail.

Under the Gangsters Act, bail is generally not granted easily. The burden of proof rests on the accused to demonstrate innocence. The Supreme Court's decision to make the interim bail absolute indicates that it found sufficient grounds to regularise the bail, possibly considering the nature of the allegations and the period of custody. However, the order does not elaborate on the specific reasons.

The condition requiring Ansari to inform the police before leaving the State is a common restriction imposed to ensure the accused remains available for investigation or trial. This allows him to travel within India but obliges him to give prior notice of any planned departure from the State.

Legal observers note that the ruling underscores the judiciary's role in balancing individual liberty against the State's interest in prosecuting crime. The Supreme Court, in several past judgments, has emphasised that bail is the rule and jail is the exception, even in cases under stringent laws. Tuesday's order appears to align with that principle.

The case against Ansari under the Gangsters Act is separate from other legal proceedings he faces. While those matters continue, this particular case has now reached a conclusive stage with regard to bail. The court's decision does not acquit him of the charges, but it allows him to be free from custody while the trial proceeds.

The Bench also included other judges, though their names were not specified in the brief order. The court did not set any additional conditions beyond the travel notification requirement.

The ruling is likely to be a relief for Ansari and his family, who have maintained that the charges against him are politically motivated. However, the court's order is based on legal considerations, and the trial will determine the merits of the case.

Supreme Court Upholds Madras HC Order Striking Down Tamil Nadu Reservation Notification for Converts

The Supreme Court has dismissed the Tamil Nadu government's appeal and upheld a Madras High Court order quashing a State notification that extended reservation benefits to converts to Islam from communities already listed as backward. A Bench headed by Justice Prashant Kumar Mishra held that conversion alone does not make a person a member of a notified backward Muslim community, and that the notification created an 'artificial group' without the statutory social checks the law requires.
