Supreme Court bans construction within 100 metres of Jojari River, restricts hazardous units

The Supreme Court has prohibited all construction and development activities within 100 metres of the Jojari River in Rajasthan, in a significant order aimed at protecting the seasonal waterway from further contamination. A Bench of Justices Vikram Nath and Sandeep Mehta also barred the establishment of hazardous industries within 500 metres of the river's flow path.

The order was passed on Monday (August 24, 2026) while hearing a suo motu case concerning the severe pollution of the Jojari, Bandi and Luni rivers in the western State. These rivers have been subjected to industrial effluents and domestic waste for years, affecting the health and livelihoods of around two million people in a region already reeling from water scarcity.

The Jojari River flows through Jodhpur, the Bandi River passes through Pali, and the Luni River runs through Balotra. The Bandi and Jojari merge with the Luni near Balotra city. The court noted that the entire industrial area in Pali is located along the river bank, and in the long run, the State authorities may have to consider relocating these industries away from the river.

Earlier, on August 4, the Supreme Court had suggested that the Rajasthan government prepare a 20-point resolution plan to comprehensively address the contamination in these rivers. The court reiterated this need, stating, “Let the State come out with a resolution plan.” The latest order is part of a series of directives issued by the court to compel authorities to take concrete steps towards river rejuvenation.

Environmental activists and local residents have welcomed the decision, expressing hope that it will lead to tangible improvements in water quality and public health. However, experts point out that effective implementation and long-term industrial waste treatment remain critical challenges. The court has also sought compliance reports from the State government to ensure the directives are followed strictly.

The ruling underscores the judiciary's role in enforcing constitutional provisions related to the right to a clean environment under Article 21 of the Constitution. It also highlights the need for sustainable industrial development that does not come at the cost of vital natural resources in arid regions like Rajasthan.

As the case progresses, the Supreme Court is expected to monitor the State's action plan closely, with further hearings scheduled in the coming months. The outcome will be crucial for the future of these rivers and the millions who depend on them.
