Pensioners' body urges repeal of Finance Act provisions to ensure uniform pension rights

The Tamil Nadu and Puducherry chapter of the All India Audit and Accounts Pensioners' Association (AIAAPA) has adopted a resolution urging the Union government to repeal the pension validation provisions in the Finance Act, 2025. The association contends that these provisions undermine the rights of pensioners by permitting distinctions based on the date of retirement.

The resolution was passed at the association's first annual general body meeting held in Chennai on Saturday, August 1, 2026. According to the association, the provisions, which came into effect retrospectively from June 1, 1972, validate the Centre's power to classify pensioners while implementing the recommendations of the Central Pay Commissions. The association says this dilutes protections available under earlier judicial rulings, including the Supreme Court's judgment in the D.S. Nakara case, which upheld the principle of equal treatment for pensioners.

The association has demanded the restoration of protections available under the Central Civil Services Pension Rules, 1972 and 2021, and the revision of pensions for all pensioners irrespective of their date of retirement. It argues that pensioners who retired before certain dates should not be treated differently from those who retired later.

Addressing the meeting, V.A.N. Namboodiri, founder general secretary of the BSNL Employees Union, said the struggle to safeguard pension rights was part of a broader global movement to protect social security. He said pensioners' organisations had challenged the Finance Act provisions in the Supreme Court, arguing that they dilute long-standing rights.

Among its other resolutions, the association sought the reduction of the pension commutation restoration period to 11 years and the grant of notional increment to employees retiring on June 30 and December 31. These measures, it said, would ease the financial burden on retirees and address anomalies in the current rules.

Officials present at the meeting included S. Mohan, president of the AIAAPA's Tamil Nadu and Puducherry chapter, S. Radhakrishna, president of the All India Audit and Accounts Pensioners' Association, and other members.

The Finance Act, 2025, passed by Parliament earlier this year, included provisions that give the government authority to frame rules for pension payments, with retrospective effect from 1972. Critics have argued that this could allow the government to override court judgments that have protected pensioners' rights. The AIAAPA's resolution is part of a wider campaign by pensioners' groups seeking to preserve their benefits.
