Panel on SC Status for Dalit Converts Misses Deadline; Report Pending

The commission led by former Chief Justice of India K.G. Balakrishnan, tasked with examining the grant of Scheduled Caste (SC) status to Dalits who convert to Islam or Christianity, has missed its June 10 deadline for submitting the report. This development has intensified the debate over the constitutional and social implications of such a move.

The three-member commission was constituted by the government in 2021 to review the provisions of the Constitution (Scheduled Castes) Order, 1950, which stipulates that only persons professing Hinduism, Sikhism, or Buddhism can be considered SC. Dalits who convert to Islam or Christianity lose their SC status under this order, a condition that has been challenged by several Christian and Muslim Dalit groups as discriminatory.

Justice Balakrishnan had earlier sought multiple extensions, citing the need for extensive consultations. The latest deadline expired without the final report being submitted. Sources within the commission indicated that the process of data collection and stakeholder meetings had been completed, but the analysis and drafting were still underway.

The government's position, as stated in Parliament, has been cautious. Official sources suggest that the Centre is not in favour of extending SC status to Dalit converts, citing potential reservations from existing SC communities and concerns over the dilution of benefits. Additionally, some SC associations have voiced opposition, arguing that the SC quota is intended to address historical injustices tied to the Hindu caste hierarchy, which does not apply to converts.

Conversely, proponents argue that discrimination based on caste persists regardless of religion, and depriving converts of SC status perpetuates injustice. They point to the fact that several states, including Tamil Nadu and Kerala, have already passed resolutions recommending such an extension.

The commission's terms of reference include studying the socio-economic conditions of Dalit converts and the impact of their inclusion on existing SC communities. It was also asked to examine whether any safeguards are needed to prevent misuse of benefits.

With the report still pending, the issue remains unresolved. The government is expected to take a final decision after receiving the commission's recommendations. Meanwhile, civil society groups and religious organisations continue to push for a resolution that balances constitutional principles and social equity.
