No More 'Advance Tip': Centre Cracks Down on Uber, Rapido Pre-Ride Tipping

The Ministry of Road Transport and Highways has directed ride-hailing platforms, including Uber and Rapido, to remove all pre-trip tipping prompts from their apps. The directive, issued through a notification, states that asking passengers for tips before a ride is completed violates the Motor Vehicle Aggregator Guidelines and the Consumer Protection Act, 2019.

The Ministry said it has observed that several ride aggregators display options such as "Advance Tip", "Choose an Add-on", or messages like "A driver may be more likely to accept this trip if you add a tip" before a ride is accepted or completed. Such prompts, the notification says, are "misleading, manipulative, or otherwise in violation" of consumer protection rules.

Under Clause 14.15 of the Motor Vehicle Aggregator Guidelines, a tip feature "shall only be visible after the completion of the journey". The clause explicitly prohibits any feature, prompt, or payment option that creates the impression that paying an additional amount may improve ride confirmation, driver acceptance, driver allocation, waiting time, or quality of service during the booking phase or while the trip is underway.

The notification further clarifies that any tip must be voluntary and can only be paid after the trip ends. "The attention of this Ministry has been drawn to the display by certain ride aggregators of prompts/options such as 'Advance Tip', 'Choose an Add-on', 'Improve your chances of quicker ride confirmation', or similar interface elements prior to acceptance or completion of a ride," the notification read.

This is not the first time regulators have flagged this practice. The Central Consumer Protection Authority (CCPA) had earlier asked ride-hailing platforms to stop displaying pre-trip tipping options. However, despite that direction, such prompts continued to appear across various apps, prompting the Ministry to issue a more explicit directive under the aggregator guidelines.

The Motor Vehicle Aggregator Guidelines were introduced to regulate ride-hailing services and ensure fair treatment of both drivers and passengers. The new clarification reinforces that tipping should not be used as a tool to influence a driver's decision or to jump the queue. By restricting tip requests to after the ride, the government aims to prevent passengers from feeling pressured into paying extra money just to get a ride or better service.

Ride-hailing companies operating in India now need to update their apps to comply with the notification. This means removing any pre-ride prompts that mention tipping or suggest that a tip could improve the chances of a ride being accepted. The apps are also required to disable any tip-related features during the trip. Only at the end of the journey can passengers be given the option to tip voluntarily.

The government's move has been welcomed by consumer rights advocates, who have often criticized the practice as manipulative. They argue that such prompts put passengers in a difficult position, especially during peak hours or in areas where getting a ride is challenging. By banning pre-ride tips, the authorities aim to create a more transparent and fair ride-hailing ecosystem.

While the notification does not specify penalties for non-compliance, the Motor Vehicle Aggregator Guidelines carry provisions for action against violators. Companies found flouting the rules could face fines or suspension of their licences, though such measures would require further orders from the government.

For now, passengers can expect that the next time they open a ride-hailing app, they will no longer see a prompt asking for an advance tip before their trip is confirmed. The government has made it clear that tipping is a post-trip gesture of appreciation, not a pre-condition for service.
