Lok Sabha debates tougher penalties for exam paper leaks as govt and opposition clash

The Lok Sabha on Wednesday witnessed a heated debate over a proposed legislation aimed at curbing exam paper leaks, with the government and opposition trading sharp remarks. The Public Examinations (Prevention of Unfair Means) Bill, 2024 seeks to impose stringent penalties, including up to 10 years in prison and fines of up to ₹1 crore, on individuals and organised gangs involved in leaking question papers.

Union Education Minister Dharmendra Pradhan, while introducing the bill, highlighted the government's commitment to ensuring fair and transparent examinations. He cited instances of past paper leaks that had adversely impacted students across the country. 'This law is not against students but against those who exploit them. It is a step to protect the future of millions of young Indians,' Pradhan said.

The opposition, however, criticised the government for what it called a 'heavy-handed approach' and demanded that the bill be sent to a parliamentary committee for further scrutiny. Congress MP Shashi Tharoor argued that the proposed penalties were disproportionate and could be misused against students. 'We support the intent to stop leaks, but the government must also address the systemic issues in examination systems and listen to the genuine grievances of protesting students,' Tharoor said during the debate.

Several opposition members pointed to recent protests in states like Uttar Pradesh and Rajasthan, where students demanded a thorough investigation into leaks and questioned police actions during demonstrations. They urged the government to ensure that the law does not curb peaceful dissent.

In response, Minister of State for Home Affairs Nityanand Rai asserted that the bill was drafted after extensive consultations and aimed to deter organised crime. 'This is not about stifling protest. It is about dismantling a network that profits from cheating honest students,' he said. The government also highlighted Prime Minister Narendra Modi's previous reform measures, including the introduction of the National Education Policy, as part of a broader effort to improve the education system.

The debate comes after a parliamentary stalemate over the issue, with both sides refusing to yield ground. The bill is expected to be taken up for a vote later this week. If passed, it will apply to all central and state-level public examinations, including those conducted by the Union Public Service Commission (UPSC) and state public service commissions.

Legal experts have noted that while the bill's intent is commendable, its implementation will require careful balancing to avoid unintended consequences. 'The law must be clear on what constitutes unfair means and ensure that genuine errors or lapses by examination bodies are not criminalised,' said senior advocate Indira Jaising.
