Kerala HC dismisses PIL against men's entry ban at women-only 'Freedom at Midnight'

The Kerala High Court has dismissed a public interest litigation (PIL) challenging the restriction on men's entry into the 'Freedom at Midnight' programme, a women-only event organised by the Department of Women and Child Development (WCD) in Thiruvananthapuram.

The court held that the petitioner, S.R. Adarsh of Thiruvananthapuram, had based his plea on unverified press reports and had not approached the authorities concerned with his grievance before moving the court. The court reasoned that it could not direct any public authority on a petition unless the petitioner's grievance had been denied by the respective public authority first.

This dismissal is on procedural grounds. The court did not adjudicate on the constitutional validity of the women-only restriction, nor did it decide whether such a restriction is permissible under the Constitution. The petitioner can approach the WCD first and, if still aggrieved, can file a fresh petition after exhausting the available remedy.

'Freedom at Midnight' is a free-entry, women-only event scheduled to be held from 10 p.m. on August 14 to 1 a.m. on August 15 along MG Road from PMG Junction to Overbridge Junction in Thampanoor, Thiruvananthapuram. The event is organised by the WCD in connection with the 80th Independence Day celebrations.

In response to the court's query, the WCD informed that the entry of men is restricted only to the event venue. Their use of the premises and transport through the area would not be impeded. This clarification was part of the department's submission to address concerns about public inconvenience.

The event is aimed at providing a safe and comfortable space for women to celebrate Independence Day. Similar gender-restricted events have been held in various parts of the country, often citing safety and security concerns. However, such restrictions raise questions about the balance between equality and special provisions for women in public spaces.

The court's decision also underscores the importance of exhausting available administrative remedies before invoking constitutional jurisdiction in public interest matters. Legal observers note that PILs based on unverified media reports and without prior representation to authorities are often dismissed at the threshold.

The 'Freedom at Midnight' programme is one of several Independence Day events planned in the state capital. The WCD has not yet issued a detailed public statement on the event's arrangements, but the department has assured the court that traffic and security measures will be in place during the three-hour event.

The dismissal does not comment on the merits of the restriction. It merely holds that the petitioner failed to follow the proper procedure. Whether the women-only policy is legally sound remains an open question that can be taken up in an appropriate forum after the petitioner approaches the authorities.

The case highlights how courts expect public interest litigants to first seek remedies from the concerned administrative bodies. It also reaffirms that PILs must be grounded in verified facts.
