Karnataka HC stays Vinay Kulkarni's conviction in murder case, grants bail

The High Court of Karnataka on July 31 stayed the trial court's conviction of former minister Vinay Kulkarni in the 2016 murder case of BJP leader Yageshgowda Goudar. The court also suspended the life sentences imposed on Mr. Kulkarni and 16 other convicts, ordering their release on bail while their appeal is pending.

A division bench comprising Justice Mohammad Nawaz and Justice G. Basavaraja passed the interim order on July 31 while allowing the interlocutory applications filed by the appellants. The bench imposed several conditions on the bail, including a direction that the accused shall not leave the country without prior permission from the court.

The special court for criminal cases involving former and sitting legislators had on April 15 convicted Mr. Kulkarni and 16 others of criminal conspiracy and murder. However, the court acquitted them of the charge under the Arms Act, 1959, as the sanction for their prosecution under that law had not been obtained.

With the stay on the conviction of Mr. Kulkarni, the order of disqualification issued by the Speaker of the Karnataka Legislative Assembly in May is set to be revoked. The Speaker had disqualified Mr. Kulkarni following his conviction. The High Court's stay means that the conviction is not operative for now, thereby removing the basis for the disqualification.

Mr. Kulkarni, who represents the Dharwad constituency, was the prime accused in the killing of Mr. Goudar in 2016. At that time, Mr. Goudar was a 26-year-old member of the BJP's zilla panchayat in Dharwad. The investigation was later transferred to the Central Bureau of Investigation by the High Court in 2019.

The trial was conducted by a special court established to handle cases against serving and former legislators. The court examined the evidence and arguments presented by the prosecution and the defence before delivering its verdict on April 15. It convicted all 17 accused, including Mr. Kulkarni, for criminal conspiracy and murder. However, the charge under the Arms Act was not sustained because the mandatory sanction for such a prosecution had not been secured.

The High Court's interim order is part of the appeal process. An appeal is a statutory right, and courts may grant bail or suspend sentences during the pendency of an appeal, particularly when the appellant raises substantial questions. In this case, the High Court has granted interim relief while the appeal is awaiting a hearing on merits.

The principle of fairness requires that a person convicted by a trial court should not be made to suffer the entire sentence before the appeal is decided. Courts, therefore, have the discretion to suspend the sentence and grant bail if the appeal is likely to take time. In this case, the High Court exercised that discretion, subject to conditions.

The legal process is not concluded. The appeal against the conviction is pending, and the final verdict will depend on the arguments presented before the court. Until then, the appellants, including Mr. Kulkarni, remain entitled to the presumption of innocence. The legal battle is far from over, and the High Court's decision on the appeal will be crucial in determining the final outcome.
