Karnataka forms Cabinet panel to review minimum wage revision amid industry opposition

The Karnataka government has constituted a Cabinet sub-committee to review the revised minimum wages notification, which has stirred a debate between labour unions and industry bodies. The panel, headed by Deputy Chief Minister G. Parameshwar, will examine whether the notification is in compliance with the Code on Wages, 2019, brought by the Union government. The decision to set up the sub-committee was taken by the Cabinet during its meeting on August 13.

The sub-committee includes Heavy and Medium Industries Minister M.B. Patil, Home, IT, BT and e-Governance Minister Priyank Kharge, Health and Family Welfare Minister U.T. Khader, Labour and Employment Minister Santhosh Lad, Education Minister Madhu Bangarappa, Small Scale Industries and Public Undertakings Minister Vijayanand Kashappanavar, and Municipal Administration Minister H.C. Balakrishna. The composition reflects the multi-sectoral impact of the wage revision.

The notification, issued on May 22, came after a gap of nearly five years, addressing a long-pending demand for revision. The revised rates apply to various categories of workers, including those in construction, manufacturing, and domestic service. According to official estimates, the revision is expected to benefit lakhs of workers across the state, with wage rates differing based on skill levels and zones.

Labour unions have welcomed the increase, stating that it is essential for workers to cope with the rising cost of living. They have argued that the previous minimum wages were outdated and failed to reflect the economic realities. The unions have also expressed confidence that the review will uphold the interests of workers.

However, industry bodies have opposed the revision, terming it steep and disproportionate. They have warned that the high increase could raise production costs, reduce the state's competitiveness, and deter potential investors. Several industry representatives have called for a reconsideration of the wage rates and the implementation timeline.

The committee's core task is to ascertain whether the notification conforms to the Code on Wages, 2019. This central legislation consolidates four existing laws - the Minimum Wages Act, 1948, the Payment of Wages Act, 1936, the Payment of Bonus Act, 1965, and the Equal Remuneration Act, 1976. It seeks to provide a universal minimum wage and a floor wage, ensuring fair and timely payment of wages to all workers.

Under the Code, the computation of minimum wages must consider factors such as the standard of living, skill levels, and the economic situation of the industry. The sub-committee will closely evaluate whether the state's notification adheres to these principles and the procedural guidelines specified in the law.

The Code on Wages, 2019, is one of the four labour codes that aim to overhaul India's labour regulatory framework. While the central government has notified rules for certain provisions, the implementation of various aspects is still pending. States are required to align their labour laws with the new codes, and Karnataka has been reviewing its regulations accordingly.

The government has stated that the review is intended to ensure legal soundness and stakeholder acceptability. The committee is expected to hold consultations with trade unions, employer associations, and legal experts in the coming weeks. Its recommendations will be placed before the Cabinet for a final decision.

The outcome of this review will have significant implications for the state's workforce and industrial landscape. It also highlights the ongoing challenge of balancing social welfare commitments with the need for economic growth and investment.

Supreme Court Upholds Madras HC Order Striking Down Tamil Nadu Reservation Notification for Converts

The Supreme Court has dismissed the Tamil Nadu government's appeal and upheld a Madras High Court order quashing a State notification that extended reservation benefits to converts to Islam from communities already listed as backward. A Bench headed by Justice Prashant Kumar Mishra held that conversion alone does not make a person a member of a notified backward Muslim community, and that the notification created an 'artificial group' without the statutory social checks the law requires.
