ITAT: Redeveloped Flat Sale Eligible for Long-Term Capital Gains Exemption

The Mumbai bench of the Income Tax Appellate Tribunal (ITAT) has ruled that capital gains arising from the sale of a flat received under a redevelopment scheme are eligible for long-term capital gains tax treatment. This decision allows taxpayers to claim indexation benefits and exemption under Section 54F of the Income-Tax Act, 1961.

Section 54F of the I-T Act permits individuals to avoid tax on long-term capital gains if they reinvest the sale proceeds of a residential house within specified timelines. The ruling clarifies that the holding period of the original flat is considered for determining whether the gain is long-term, even if the taxpayer received a new flat in exchange under a redevelopment agreement.

The tribunal observed that the transaction effectively involves a transfer of the original property, and the new flat received is merely a replacement. Therefore, the capital gains should be computed based on the cost of acquisition and the period of holding of the original flat. This interpretation provides significant tax relief to homeowners participating in redevelopment projects.

Experts note that this ruling aligns with the intent of Section 54F, which aims to promote home ownership and reinvestment in residential property. Taxpayers who have sold their redeveloped flats within three years of receiving possession should consult a tax advisor to determine eligibility for the exemption. However, the applicability of the ruling may vary depending on the specific facts of each case and the terms of the redevelopment agreement.

The ITAT's decision is binding on lower tax authorities within its jurisdiction and serves as a persuasive precedent for other benches. It is expected to reduce litigation on this issue and provide clarity to taxpayers engaged in redevelopment transactions.
