Hyderabad court convicts 33 in trafficking, exploitation case; five get life term

In a significant judgment, a special court in Hyderabad on Wednesday convicted 33 persons in a human trafficking and sexual exploitation case, with five of them sentenced to life imprisonment. The court also ordered compensation of ₹5 lakh each to nine victim girls, in addition to amounts they had already received under the law.

The Special Sessions Court for POCSO Act Cases, FTSC, HACA Bhavan, delivered the verdict in a case registered by the Women Safety Wing of the Crime Investigation Department (CID) in 2015. The accused were prosecuted for offences under the Indian Penal Code, the Protection of Children from Sexual Offences (POCSO) Act, and the Immoral Traffic (Prevention) Act, among other laws.

The case came to light after a victim approached the CID on July 17, 2015. She reported that she had been promised employment by an acquaintance from her village. Instead, she was introduced to three others and taken to various locations, where she was allegedly forced into prostitution, assaulted, and sexually exploited. She remained under their control for about four months before escaping and filing a complaint.

Following her complaint, the CID conducted searches and raids at brothel premises. During these operations, 45 accused persons were apprehended, and nine minor girls, along with other victims, were rescued. Incriminating material was also seized from the premises.

After a thorough investigation, the police filed a charge sheet before the court. The trial proceeded, and the court found 33 of the accused guilty. Of the 45 apprehended, the remaining accused were either acquitted or dealt with separately. In its verdict, the court sentenced three accused to rigorous imprisonment for 14 years, 14 to rigorous imprisonment for 10 years, and 11 to rigorous imprisonment for three years. The remaining convicted persons received varying sentences.

The court also directed the Secretary of the District Legal Services Authority to take steps for the payment of compensation to the victims at the earliest. The fine amounts imposed on the accused were also ordered to be paid to the victims as compensation. Under the POCSO Act and related laws, compensation is provided to support rehabilitation and recovery of victims.

The victims, mostly minors at the time of the offence, endured severe physical and psychological trauma. The court's order for compensation is intended to facilitate their rehabilitation and reintegration into society, recognizing the long-term impact of such crimes.

The trial was conducted in-camera, as mandated under the POCSO Act, to protect the identity and dignity of the minor victims and witnesses. Such procedural safeguards are critical in cases involving sexual exploitation, where the risk of retraumatization and social stigma is high.

Cases of human trafficking and sexual exploitation are complex, often involving networks of offenders and victims from vulnerable sections of society. The investigation in this case included raids, rescue operations, and collection of evidence from multiple locations. The court's verdict comes after a thorough judicial process, during which the prosecution examined witnesses and presented documentary evidence.

Human trafficking for sexual exploitation is a grave violation of human rights and a serious criminal offence. The POCSO Act, enacted in 2012, specifically aims to protect children from sexual offences, while the Immoral Traffic (Prevention) Act addresses trafficking and commercial sexual exploitation. Courts are mandated to conduct trials in a manner that is sensitive to the needs of victims, particularly minors.

The conviction marks a significant step in the legal process, underscoring the efforts of law enforcement to bring perpetrators of such crimes to justice. The convicted persons have the right to appeal the verdict in a higher court.

Supreme Court Upholds Madras HC Order Striking Down Tamil Nadu Reservation Notification for Converts

The Supreme Court has dismissed the Tamil Nadu government's appeal and upheld a Madras High Court order quashing a State notification that extended reservation benefits to converts to Islam from communities already listed as backward. A Bench headed by Justice Prashant Kumar Mishra held that conversion alone does not make a person a member of a notified backward Muslim community, and that the notification created an 'artificial group' without the statutory social checks the law requires.
