Government Introduces Stricter Public Examinations Bill After Minister's Exit Over Leaks

In a significant move to address persistent concerns over examination integrity, the Union government tabled the Public Examinations (Prevention of Unfair Means) Amendment Bill in the Lok Sabha today. The bill, introduced by the Ministry of Education, seeks to impose harsher penalties for paper leaks and other malpractices in public examinations conducted by central agencies.

The introduction follows weeks of protests by students and opposition parties after a series of high-profile paper leaks, which led to the resignation of Union Education Minister Dharmendra Pradhan. The government views the amendment as a critical step to restore public trust in the examination system.

Key provisions of the bill include an increase in the maximum prison term from three years to ten years for those found guilty of leaking question papers or facilitating unfair means. Additionally, fines have been raised to up to ₹10 crore. The bill also expands the definition of 'public examination' to cover more recruitment and entrance tests conducted by central bodies, including those by the Staff Selection Commission, Railway Recruitment Boards, and the National Testing Agency.

Offences under the bill are now classified as cognizable and non-bailable, allowing for arrest without a warrant. The bill also proposes the establishment of a Centralised Examination Monitoring Authority with powers to probe suspected malpractices and recommend policy changes.

Critics, however, argue that the bill's stringent provisions may disproportionately affect students and lower-level staff while failing to address systemic issues like lack of transparency in examination processes. Some opposition members have called for greater consultation with states, as many public examinations are conducted by state governments.

The original Public Examinations (Prevention of Unfair Means) Act, 2024, was passed to curb paper leaks and cheating but faced criticism for its limited scope. The latest amendment aims to close loopholes and align punishments with the gravity of offences that disrupt the careers of millions of aspirants.

The bill is expected to be referred to a parliamentary committee for detailed scrutiny before being brought back for passage in the monsoon session. As the debate unfolds, all eyes are on whether this legislative tightening will indeed deter malpractices or merely escalate the arms race between exam authorities and those attempting to subvert them.
