Goa moves Supreme Court seeking life term for Tarun Tejpal in 2013 rape case

The State of Goa has approached the Supreme Court challenging the 10-year prison sentence awarded to former Tehelka editor Tarun Tejpal in a 2013 rape case, calling the punishment "grossly disproportionate" to the gravity of the offence. The petition, filed on Tuesday, seeks enhancement of the sentence to imprisonment for life, arguing that the term imposed by the Bombay High Court was manifestly inadequate.

In its appeal, the State clarified that it does not intend to challenge or reopen the findings on merit recorded by the High Court in its August 6 judgment. That judgment had set aside Tejpal's acquittal by a Goa sessions court in 2021, terming the trial court's order "perverse" and convicting Tejpal of raping a junior colleague inside a hotel elevator during an event organised by the magazine in Goa in 2013.

The State's petition contends that the 10-year sentence is not commensurate with the severity of the crime. It states, "The present case warrants enhancement of sentence to imprisonment for life, or such enhanced sentence as this court may deem appropriate, and the sentences ought not to have been directed to run concurrently." The reference to concurrent sentences indicates that Tejpal was given multiple sentences, likely for different offences, which are currently set to run together.

During the hearing before the High Court, Tejpal had pleaded for leniency, describing himself as a "political victim" and the father of two daughters. Solicitor General Tushar Mehta, representing the Goa government, had countered that demand by urging the court to impose the maximum punishment to send a strong message about the seriousness of sexual offences against women in the workplace.

The case has been closely watched as a test of judicial accountability in cases involving powerful individuals. Tejpal, a prominent journalist, was arrested in 2013 after the victim filed a complaint, and the trial began after years of legal proceedings. The Supreme Court will now examine whether the High Court's sentence adequately reflects the nature of the crime, and whether a life term is warranted.

Legal experts note that the Supreme Court's decision could set a precedent for how similar cases are treated, particularly when a conviction is upheld on appeal but the sentence is questioned for being too lenient. The victim's identity is protected under Indian law, and her rights remain a central consideration in the proceedings.

Supreme Court Upholds Madras HC Order Striking Down Tamil Nadu Reservation Notification for Converts

The Supreme Court has dismissed the Tamil Nadu government's appeal and upheld a Madras High Court order quashing a State notification that extended reservation benefits to converts to Islam from communities already listed as backward. A Bench headed by Justice Prashant Kumar Mishra held that conversion alone does not make a person a member of a notified backward Muslim community, and that the notification created an 'artificial group' without the statutory social checks the law requires.
