Foreign women inmates in Bengaluru prison face delays despite completing sentences

The Karnataka State Commission for Women has drawn attention to the prolonged detention of several foreign women inmates at Parappana Agrahara Central Prison, even though they are eligible for release. The commission chairperson, Nagalakshmi Chowdhary, highlighted that many of these women remain in custody because they are unable to furnish the required bail amount and sureties.

During an inspection of the prison on August 18, Dr. Chowdhary interacted with the inmates and found that several foreign nationals had completed their sentences but were still detained. She noted that the government has a provision to provide up to ₹40,000 towards the surety amount for eligible inmates. However, some women have bail or surety requirements exceeding ₹1 lakh, making it difficult for them to secure release. In certain cases, courts insist on land or property-based surety, which poses a major hurdle for foreign nationals who do not own local property or have relatives in India capable of standing as sureties.

Dr. Chowdhary said she would take up the matter with the State government and explore legally permissible alternatives to ensure that eligible inmates are not kept in prison merely because they cannot arrange the required surety. The issue is especially relevant for foreign women inmates from countries including Pakistan, Bangladesh, and South Africa, she added.

The inspection also brought to light a shortage of women prison staff, which is placing an additional burden on the available personnel. In some instances, a single supervisor is reportedly tasked with monitoring more than 200 women inmates during the night, making effective supervision extremely challenging. The commission was also informed that women staff members face difficulties in arranging transportation after completing late-night shifts, raising concerns about their safety and convenience.

Apart from these issues, Dr. Chowdhary examined the overall conditions of the prison. She visited the kitchen, assessed the quality of food, and tasted the inmates’ meals. She reviewed drinking water facilities, sanitation, medical and psychiatric services, and childcare arrangements. She also stressed the need to give greater priority to education and skill-development programmes aimed at rehabilitation.

The chairperson examined complaints regarding alleged irregularities in the prison, sought details from officials, and discussed corrective measures. The commission’s findings are expected to be shared with the State government for action.

Supreme Court Upholds Madras HC Order Striking Down Tamil Nadu Reservation Notification for Converts

The Supreme Court has dismissed the Tamil Nadu government's appeal and upheld a Madras High Court order quashing a State notification that extended reservation benefits to converts to Islam from communities already listed as backward. A Bench headed by Justice Prashant Kumar Mishra held that conversion alone does not make a person a member of a notified backward Muslim community, and that the notification created an 'artificial group' without the statutory social checks the law requires.
