Delhi High Court Lifts Gag Order on The Wire, Calls Pre-Publication Censorship Unjustified

The Delhi High Court on Monday recalled a gag order that had restrained digital news platform The Wire and a journalist from publishing future reports about former Delhi chief secretary Naresh Kumar. The court held that it is not legally permissible to presume that a future publication would be defamatory simply because of past publications by the same author or publisher.

“There is no conceivable way, whether in fact or in law, by which it can be presumed that what an author or publisher is proposing to publish would be defamatory, even going by any past publication that may have been made by the author/publisher,” the court observed.

The gag order had been issued in November 2023 after Kumar filed a defamation suit against The Wire. The suit stemmed from a news report alleging that Kumar's son was linked to a case of over-valuation of land, reported by journalist Meetu Jain. The article also reportedly recorded Kumar's assertion that there was no conflict of interest on his part in the alleged land deal.

Kumar had argued before the court that “certain disgruntled elements, against whom action has been taken or is under way, including in matters relating to the so‑called Delhi Excise Scam and Sheesh Mahal issue” had circulated allegedly false and fabricated complaints against him. However, the High Court found that this did not justify a blanket ban on future publications.

The ruling is seen as a significant affirmation of press freedom, as it curtails the use of pre-publication injunctions that can stifle reporting. The court emphasized that any defamation claim must be assessed based on the specific content published, not on assumptions about what might be published in the future.
