Delhi High Court denies bail to man accused of killing wife, disposing body in septic tank

The Delhi High Court has declined to grant bail to a man accused of murdering his wife, dismembering her body and allegedly dumping the remains in a septic tank. The court observed that the severity and manner of the alleged crime could not be ignored while deciding the bail application.

Justice Girish Kathpalia dismissed the bail plea on August 20, noting that while a delay in trial is a relevant factor for granting bail, it is not the sole consideration. The court must also assess the nature of the offence and the circumstances presented in the case.

“Of course, delay in trial is a ground for grant of bail. But that is not the only ground. While considering grant or denial of bail, the court cannot shut its eyes to the gruesome manner in which a lady was killed followed by chopping off of her body and throwing her in the septic tank,” the court said.

According to the prosecution, the case was registered in 2019 after the accused allegedly approached a police station and confessed to killing his wife. He reportedly stated that he chopped her body into pieces and disposed of the remains in a septic tank.

During the investigation, the police also received a PCR call from the victim’s brother, who alleged that the woman had been murdered and that her body had been recovered from the septic tank. Subsequently, an FIR was registered.

The victim’s brother further alleged that the accused and his family had subjected her to cruelty and demanded dowry because she had given birth to three daughters. These allegations formed part of the prosecution’s case against the accused.

In his bail plea, the accused argued that there were material contradictions in the testimonies of the victim’s mother and brother. His counsel also contended that the trial was progressing slowly, and therefore, the accused was entitled to bail on the ground of delayed proceedings.

The prosecution opposed the bail application, stating that the trial was not being unduly delayed and that the seriousness of the allegations weighed against granting bail. The prosecution also highlighted the alleged recovery of a blood-stained weapon, along with the victim’s clothes and jewellery, which had been sent for forensic examination.

Taking into account the overall circumstances and the nature of the allegations, the High Court concluded that it was not a fit case for granting bail. The plea was accordingly dismissed.

This ruling underscores the legal principle that bail decisions are not made solely on the basis of trial delays, but also consider the gravity of the offence, the conduct of the accused, and the evidence available. The case continues to be tried in the lower court, where the accused will have the opportunity to defend himself against the charges.

Supreme Court Upholds Madras HC Order Striking Down Tamil Nadu Reservation Notification for Converts

The Supreme Court has dismissed the Tamil Nadu government's appeal and upheld a Madras High Court order quashing a State notification that extended reservation benefits to converts to Islam from communities already listed as backward. A Bench headed by Justice Prashant Kumar Mishra held that conversion alone does not make a person a member of a notified backward Muslim community, and that the notification created an 'artificial group' without the statutory social checks the law requires.
