Delhi Court Rebukes NCB for Vague Bail Opposition, Demands Explanation

The Narcotics Control Bureau (NCB) has come under sharp criticism from a Delhi court for its handling of bail applications. Special Judge Jitendra Pratap Singh expressed disappointment over the agency's failure to provide specific evidence linking the accused to the alleged offence while contesting a bail plea.

In an order passed on July 30, the court noted that neither the original investigating officer nor the officer handling the case could specify the material that directly connects the applicant to the alleged crime. The judge remarked that he was expressing his disappointment with the conduct of the agency in contesting bail applications.

“With great reluctance, this court is expressing its disappointment as to the conduct of the affairs of the agency in contesting the bail applications,” the order stated. It highlighted that due to heavy pendency of cases, the court typically issues a notice of about 45 days on bail applications. However, on several occasions, the hearing has to be adjourned because the prosecution fails to provide the requisite assistance.

“In such circumstances, it is directed that the copy of this order be placed before the zonal director, NCB, asking him to furnish an explanation in light of the reply to the instant bail application,” the judge directed. He also asked the NCB director to state whether the reply filed in the matter is sufficient for recording the agency's opposition to the bail application.

The development underscores a recurring issue in the criminal justice system: the quality of investigation and prosecution. When a law enforcement agency opposes bail without a clear articulation of the evidence, it not only wastes judicial time but also undermines the right to a fair and speedy trial.
