CBI formally takes over K. Armstrong murder probe after legal hurdles

The Central Bureau of Investigation (CBI) has formally taken over the investigation into the murder of K. Armstrong, the Tamil Nadu president of the Bahujan Samaj Party (BSP), who was hacked to death near his residence in Chennai on July 5, 2024. The development comes nearly two years after the crime, following a prolonged legal tussle over who should investigate the case.

A senior police officer confirmed the handover on Friday, stating, “We have formally handed over the case files to the CBI. The move follows the withdrawal of the Special Leave Petition filed by the State in the Supreme Court.” Police sources indicated that the CBI is expected to re-register the case within a few days.

The case was initially investigated by the Greater Chennai Police, which filed a 7,411-page chargesheet against 30 accused persons. However, the Madras High Court, on September 24, 2025, transferred the probe to the CBI in response to a petition filed by Armstrong’s brother, K. Immanuel. Immanuel had alleged that the local police failed to conduct a proper investigation. The court also quashed the chargesheet, with Justice P. Velmurugan observing that many criminal cases end in acquittal due to investigation flaws, and that the case before him was a classic example.

The State of Tamil Nadu challenged the High Court order in the Supreme Court. While the apex court stayed the quashing of the chargesheet, it allowed the transfer of the investigation to the CBI to continue. This created a procedural impasse, as the case files were not immediately handed over to the CBI.

In November 2025, Armstrong’s wife, Porkodi Armstrong, moved the Supreme Court alleging that the State had not transferred the probe papers to the CBI. Her petition is believed to have expedited the process, culminating in the formal handover this week.

In a related development, one of the prime suspects, K. Thiruvengadam, was killed in what the police described as an “encounter” after he allegedly escaped custody and attacked police while being pursued near Madhavaram. The encounter has been a subject of scrutiny, with civil liberties groups demanding an independent inquiry, though the police maintain that the action was in self-defence.

The case has significant political and social implications. Armstrong was a prominent Dalit leader in Tamil Nadu, and his killing sparked widespread outrage and protests. The transfer of the investigation to the CBI is seen as a step towards ensuring a credible and independent inquiry, given the concerns raised about the state police’s handling of the case.

Legal experts note that the CBI probe will now proceed from the stage of re-registering the FIR. The CBI will examine the evidence already collected, including the earlier chargesheet, and may choose to conduct fresh investigations if necessary. The withdrawal of the Special Leave Petition by the State has removed a major legal obstacle, allowing the CBI to function without further judicial interference.

Observers say the case will test the CBI’s ability to conduct an impartial investigation in a politically sensitive matter. The agency is expected to scrutinise the role of the accused, the sequence of events leading to the murder, and any potential lapses by the local police during the initial probe.

Armstrong’s family has expressed cautious optimism about the CBI investigation but has called for a thorough and time-bound probe. They have also urged the authorities to ensure the safety of witnesses and cooperation from the state machinery.

The murder of K. Armstrong remains one of the most high-profile crimes in Tamil Nadu in recent years. The formal takeover by the CBI marks a crucial juncture in the pursuit of justice, even as the family and the public await accountability.
