Calcutta High Court: Aadhaar, Voter ID, PAN Card Not Proof of Citizenship
The Calcutta High Court has ruled that documents such as Aadhaar cards, PAN cards, voter identity cards, bank passbooks, and ancestral land records are not conclusive proof of Indian citizenship. The judgment came while the court refused to interfere with the detention of a man alleged to be a Bangladeshi national.
A division bench of Justice Debangsu Basak and Justice Ajay Kumar Gupta dismissed a habeas corpus petition filed by a man claiming to be the detainee's uncle. The petitioner alleged that his nephew had been wrongfully detained since June 18, 2026.
“Writ petitioner and the detainee fail to prove the Indian citizenship of the detainee. Writ petitioner and the detainee are unable to discharge the burden of proof as mandated by the Immigration and Foreigners Act, 2025,” the court said in its order.
The court's observation underscores that commonly used identity documents are issued for administrative purposes and do not automatically confer citizenship status. The burden of proving citizenship lies with the individual claiming it, especially in cases involving alleged foreign nationals.
Legal experts note that citizenship determination in India is governed by the Citizenship Act, 1955, and related laws. Documents like Aadhaar are meant for identification and welfare scheme access, not as proof of nationality. The ruling aligns with earlier judicial pronouncements that citizenship must be established through specific legal processes.
The case highlights ongoing complexities in India's citizenship verification framework, particularly for individuals suspected of being illegal migrants. The court did not comment on the detention's legality beyond the citizenship issue.
