Allahabad HC Rules Headscarf Not Essential Islamic Practice; Dismisses Student's Hijab Plea

The Allahabad High Court has ruled that wearing a headscarf cannot be established as an “essential religious practice” for women in Islam, dismissing a petition filed by a Class 11 student who sought permission to wear a hijab along with her prescribed uniform at Tagore Public School in Prayagraj.

A Division Bench comprising Justice J.J. Munir and Justice Indrajeet Shukla passed the order on August 21, 2026. The student had approached the court seeking to overturn the school’s decision that required her to follow the uniform code without any additions. She argued that wearing a headscarf was an essential part of her Islamic faith and was protected by her fundamental rights to equality and freedom of expression under Articles 14 and 19(1)(a) of the Constitution. She said she had been wearing the headscarf at the school without objection from Class 6 onwards.

The court, however, rejected the argument that long-standing practice translated into a legal entitlement. Even if the student had worn a headscarf for several years, the court said, this fact alone did not create an enforceable right to compel the school to relax or alter its uniform policy.

In its order, the court said it had examined photographs from various classes and observed that no other girl student, including those from the same religious community as the petitioner, wore a headscarf. The court noted that whenever this issue has arisen, high courts across the country have been unanimous in holding that wearing a headscarf is not an essential part of the Islamic faith for a woman.

“In the absence of which, faith would be jeopardised” is the test the court applied. The High Court emphasised that no factual foundation had been laid nor material placed on record to establish that donning a headscarf was essential to the petitioner’s religion. It said she had failed to show that not wearing a headscarf would exclude her from the faith she professed and practised.

The Allahabad High Court relied on earlier decisions by the Bombay High Court and a Full Bench of the Karnataka High Court. The Bombay High Court had held that not wearing a head covering in an all-girls section did not violate essential Islamic practices. The Karnataka High Court, in a similar case, found that the hijab was not an essential religious practice, while noting that the Supreme Court had delivered a split verdict on the issue.

The court then addressed the core of the dispute. It concluded that the matter was not about interference with religious freedom but about adherence to an institutional dress code. The school, the court said, had not sought to curtail the petitioner’s freedom of faith. It only required conformity to institutional discipline, of which a uniform is an essential part.

“In the event individual students were permitted to aid or depart even a little bit from the prescribed uniform on subjective grounds, it would militate against the idea of a uniform. It would transfer the authority to determine school discipline from the institution to individual students,” the court observed.
